Subject to these Terms of Service (this "Agreement"), RustMailer ("RustMailer", "we", "us", and/or "our") provides access to the RustMailer website and license management services (collectively, the "Services"). By using or accessing the Services, including purchasing licenses, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to this Agreement. If you do not have such authority or do not agree with this Agreement, you must not accept this Agreement and may not use the Services.
1. Acceptance of Terms
By signing up, purchasing a license, or using the Services provided by RustMailer, you agree to these Terms of Service. RustMailer reserves the right to update or modify these Terms at any time, and your continued use of the Services constitutes acceptance of those changes.
2. Description of Service
RustMailer is a software product that users download and install independently from GitHub or other distribution channels. Our website provides user account management via Clerk and license key sales via Stripe.
3. License Purchase and Use
- You must purchase a valid license key to use RustMailer beyond any free trial period.
- License keys are provided electronically via email associated with your account.
- License keys grant you the right to use RustMailer according to the license terms provided separately.
- You are responsible for safeguarding your license key and account credentials.
4. User Responsibilities
You are responsible for complying with all applicable laws and regulations when using RustMailer. You agree not to use RustMailer or its services for any illegal, unauthorized, or harmful activities.
RustMailer reserves the right to suspend or terminate your access to the website, license services, or software if you violate these Terms or engage in prohibited conduct.
5. Payments and Billing
All payments for licenses are processed through Stripe. We do not store or have access to your payment information. Please refer to Stripe's Privacy Policy for details on payment processing and data security.
6. Intellectual Property Rights
RustMailer retains all intellectual property rights in the software and Services, including copyrights, trademarks, and trade secrets.
7. Software License Agreement
By purchasing and using RustMailer software, you agree to be bound by the terms of the separate Software License Agreement that governs your rights and obligations related to the software itself.

Please note that if you request and receive a refund under our satisfaction guarantee policy, your license to use RustMailer will terminate immediately in legal terms. Upon such termination, you waive any further claims for damages or compensation related to the refunded license.
8. Changes to Terms
We may update these Terms at any time by posting the revised version on our website. Continued use of the Services after such changes constitutes your acceptance of the updated Terms.
9. Disclaimer of Warranties
RustMailer software and Services are provided "as is" without warranties of any kind, either express or implied, including but not limited to merchantability or fitness for a particular purpose.
10. Limitation of Liability
To the fullest extent permitted by law, RustMailer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, or data arising from the use or inability to use the Software or Services.
Any claims arising shall not exceed the amount paid by you for the license during the 12 months prior to the claim.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall first be subject to good faith negotiation between the parties. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Privacy and Data
RustMailer does not collect, transmit, or store any user data or email content.
Once installed, RustMailer runs entirely within your own environment and is fully isolated from the Author’s servers or website.
No telemetry, usage data, or personal information is sent to or collected by the Author or any third parties.
